We always put have probable cause to believe, even if we saw him. Why? Because us seeing him do it is probable cause, too, and it keeps us from accidentally selecting the other option when we didn't actually see him commit the crime. The defense would tear us apart for that mistake.

If you have Probable Cause to Believe ... then it is Suspicion of...

In case you don't know, I'm not very anti-cop, but things like:

Shit, in most states that cop could be legally shot, since he hadn't presented proof he was an officer. Things like that make me worry about police, and them having any responsibility to protect and serve.

But if everything in that article actually happened... the guy is lucky he's not dead.

If everything in that article is true, then the officer was in the right.

1. The officer may not have been in uniform or in a marked car, but if he had his pistol on him then he also had his badge. The article said he Identified himself as an officer.
2. The GF drove the car at the officer before he ever shot the suspect, causing him to have to fire 2 round into the car first.
3. The article didn't say that the suspect was unarmed... the article said it wasn't clear whether he was armed or not... but that really doesn't matter... If I have a gun on you and you reach inside your beltline like you are going for a gun, you are probably going to get shot.. especially if I've already had to dodge a car and fire into it.
4. Even after the suspect got shot he kept coming at the officer.
5. The suspect has a history of problems with cops, which makes the officer's side of the story believable.

There may be more to the story than what is in that article... almost definitely... but just from that article the officer is in the right.

Anyone can make a mistake.. but the chances of the cops..the detectives..the DA...the judge..12 jurors.. 3 appellate courts(three judges on each one)..and the 5(or 7 in some states) man state supreme court all making the same mistake is vanishingly rare.

Well, Cali has a problem with Mexican gangs dressing in very authentic police uniforms and police cars, complete with faked badges, just to arrest people to kidnap them for ransom or to murder them. Someone without a marked car can wait for backup while I sit in my car, thank you.

Actually they probably charged his with the weapons law violation as a favor.

No, I'm not being a smart ass when I say that.

He's only been out for what, a week? ya think he didn't shove that awl up his rear and then go in public and do something guaranteed to get him arrested on purpose. Old boy is totally institutionalized. The outside is totally different than when he went in, prob. No place to stay.. hard time finding a job... actually have to bust ass to make a living... might as well go back in where life is much simpler.

So, instead of having to arrest him every 30 days on minor stuff, they got him on the weapons charge... which is a parole violation. He'll plead guilty... get his parole revoked... and go back inside where it is safe *blink*

Everyone is happy... The court costs of trying him every 30 days for minor stuff would cost more in the long run than just revoking his parole. It leaves officers available to deal with other stuff instead of being tied up with him. *shrug*

It really is the only way to deal with an institutionalized person... they'll just commit crimes until you arrest them anyway.
