I work for a railroad, and I have personally seen a case where a guy and his friends were drunk, they ignored the lights and drove around the crossing gates, were hit by a train and died. The vics family sued us and won. Sometimes a jury will side with the little guy simply because they feel sorry. They figure that a few hundred thousand dollars will not hurt the company, and the victims family could use the money. If the crossing had no gates or lights, that is a point a lawyer can latch onto, regardless of the actions of the mother.

It is too bad that when the railroad networks of the United States were built that the builders did not foresee that in the future, the average American attention span, and IQ, have posted severe drops. Thus, the builders of that time could have eliminated all grade crossings, for it is my opinion that people are too stupid to be around trains. Or trucks. Or ships. Or airplanes. Or moving equipment of any kind. In the article, it mentioned about cash donations to the R-Tard who created this mess, but where is there donations to the train crew that were POWERLESS to prevent this? On some railroads, it is rare to NOT have a train crew that has killed someone at a grade crossing. That's what people don't understand about trains. They can't be stopped on a dime. I really would like to see pictures of tards who accidentally or purposely tackled a moving train be posted at every commuter train station and railroad crossing (upchucking pictures like Ogrish used to have, except now it's white bread Live Leak).
