"A few too many drinks, a stumble and a fall on Bourbon Street, and the appearance of a dispute, which the men say was overblown, resulted in misdemeanor disorderly conduct charges against them and an overnight visit to the Orleans Parish Prison. In normal times, Mr. Kunkel, 44, and Mr. Waganfeald, 39, would have paid fines totaling about $300 each the following morning - a Saturday - fetched their car from the French Quarter parking garage, retrieved their luggage from the Super 8 motel on nearby I-10, and left for Toledo. There was nothing normal about that weekend in New Orleans."

No but seriously, looks like these two guys got a serious screwing from the local authorities, which does not shock me one bit. Cops in the 'Quater are well reported to be a bunch of pigs, out comes the pepper spray, batons and handcuffs at the slighest need.

I used to go to Mardi Gras and Jazz Fest every year for probably 8 years in a row (pre marriage/pre kids). Law enforcement in the Quarter during Mardi Gras was something to see.

Best example ever: My gf and I had ducked out of the mass in the street to try and get into a bar (I think at the corner of Bourbon and Dumaine), but the line was up around the corner. We went back up the cross street to see how long it was, and there were two NOPD cruisers parked behind the barricades, with three officers leaning on the hoods watching a young guy on the ground in front of them. At first we couldn't see what was happening, but as we came around the end of the line, we realized that this kid had his jeans around his ankles and was taking a shat in the gutter. He was so plastered that he didn't even realize the cops were 6 feet away from him. The one of the cops was laughing at the other two, telling them that he was happy it was "their turn". The other two were obviously not very cheerful. But they let this kid get done with his business, and when he stood up to pull his pants up, one of the cops grabbed his shoulder and said "What the fuk do you think you're doing, dumbass?" The kid started crying. BUt the best (or worst, depending on perspective) part was when the second cop came over and told the guy to pick his shit up out of the street, or they were going to hit him with littering as well as disorderly conduct. If you've ever been to Mardi Gras, you know that by midnight the streets are several inches deep with spilled booze, piss, and vomit. And they made him fish his turds out of the slime, and carry them in his hands to a dumpster behind the building, before they zipstripped him and carted him off.

These two guys really did get the old "in-and-out" from the government, especially that of New Orleans and Louisiana. I suppose the usual precedent for cases like this is to start paying them something like $100 for each day they were in prison longer than they should have been, which for these two unlucky men comes out to nearly $30 grand. At least that might prevent the one guy with the eye infection from suing the city of New Orleans and the State of Louisiana for all it's worth (which isn't much more than the $30 grand that we calculated just now).

And this $100/day thing isn't just for these two guys, but for every other person who was held longer than his/her maximum imprisonment because of the incompetence of the New Orleans criminal justice system. If this ends up ruining these two friends' lives, they would have a good case to bleed the city of New Orleans and the State of Louisiana dry in court.

But this from the country that clings to the death penalty as a legal sentence in the courts of law...not really a surprise. Apparently a great many Americans think that if you're in prison for any reason, you probably deserve to rot there, unless you're getting the death penalty, in which case you deserve to die. Also keep in mind that these people can't understand the fact that the death penalty costs more than actually keeping the offender in prison, doesn't really provide catharsis for the people the victim left behind, and is generally considered a failure as a deterrent.

When we need the area for shipping, it would behoove us to protect it as a resource vital for the security of our nation. Our biggest security problem is economic security. Random explosions, fires, and death from gunshot wounds doesn't matter a hell of a lot when you're not eating and you don't have a roof over your head.

It is a very serious civil rights violation to lock a misdemeanor suspect up with felons or felony suspects. When I was in Ft. Worth, doing federal felony time, we had some poor kid locked up with us in our 14-man dorm (all whites and Mexicans.) It seems he had been a civilian caught driving while alcohol-impaired on a military base. He got some months of probation from a federal judge-magistrate. He violated probation by having a non-violent domestic dispute with his girlfriend (a noisy argument.) The guy didn't have ANYTHING. No soap, no laundry detergent, no postage stamps, no shower sandals, no comb, no toothbrush, no razor, no shaving cream, no toothpaste, no shampoo; only a bedroll and his clothing issue. He had a "deer caught in the headlights" look that would have made you cry.

We looked out for him - took him on as a sort of mascot, and told him where he could get a free comb, stationary, envelopes, soap, shampoo, pencils, razor, toothbrush, toothpaste and shaving cream; the COs' duty office. I took him to the chapel to get free shower shoes. We chipped in and gave him some postage stamps so he could write home and at least tell his family where he was. Somebody gave him an extra plastic coffee cup and we chipped in and gave him some instant coffee and laundry detergent in empty, cleaned-out plastic peanut butter jars.

The guy was only with us two weeks, but before he left he told us how sorry he was that guys like us had been locked up. "Shit," I said, "They don't lock you up for being a bad man anymore. When you get home, find a lawyer and sue the Justice Department up one side and down the other. You weren't supposed to be here with us."

The corrections officers who left those men behind bars to drown should be charged with reckless endangerment at the very least. Getting drunk and falling down on the sidewalk should NEVER mean that you are locked in a hole and left to die.

Well well. Bad deal for these guys. I went down with my bobtail(big rig without the trailer) and got a taste of good old new orleans's hospitality(note, I didn't capitalize the city's name). Went to the Hilton's parking lot, and asked to be allowed to park there for a few minutes, while I was going to check on some friends staying there. Can you believe they wanted to charge me $53.95 a day? So, I found a place in the french quarter away from any vehicles to park, and went back to the hotel to check on my friends. Upon returning, some people had parked a four wheeler by my bobtail, trying to block me in. I was able to leave, and head on up North. I had enough of the place, and was kinda intimadated by all the water surrounding the city. I've been in new orlean's in the past, as a kid in the late sixties. It sure has gotten seedy, and snooty since then. No big loss in my book. EWJ

We still have Baton Rouge. It seems to me that we could dredge the Mississippi to allow large ships to go to Baton Rouge. The dirt and rock dredged up could be dumped in New Orleans to raise it above sea-level thus killing two birds with one stone. I particularly favor dumping river mud on the Ninth Ward.
