I find it hard to believe there's nothing about sexually abusing their help in the contract. Redundancy is a waste of paper and ink and it shouldn't take a corporate rule book to know you don't sexually abuse the help. As for their liability, if McDonald's had had trouble with this prank caller before, the should have made for damn sure that everyone in their employ was familiar with the situation and told how to handle it, personal stupidity notwithstanding. One can get all the judgments in the world, but if your judgment debtor has no assets, you ain't got shit; what you've got is a nice, pretty, Order of Court that gives you exactly squat. Sure, you've got a judgment for X amount of money damages. But unless you can levy against a real asset, there's nothing there. It's called having a Defendant who is judgment-proof. Anyway, if McD's did get a judgment against the idiot manager, she'd likely be able to discharge it in Bankruptcy, even under BAPCA.
